The petitioner joined the service of Osmania University as Assistant Professor in Physical Education Department. Later on, he was promoted to the post of Associate Professor. The University Grants Commission introduced Career Advancement Scheme for promotion of Assistant Professors to the post of Associate Professor and Associate Professors to the post of Professor, subject to certain conditions. An Associate Professor must possess Ph.D. Degree for being considered for promotion to the post of Professor. The interviews for the current academic year are scheduled to take place on 12.08.2011 for that purpose.

The grievance of the petitioner is that the respondents are not considering his case for Career Advancement Scheme on the ground that Ph.D. Degree obtained by him is from Vinayaka Missions University, Salem, Tamilnadu. He seeks direction to the respondents to consider his case for promotion under Career Advancement Scheme.

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

The post of Professor occupies an important position in the University or for that matter, in any institution. It is under his guidance that the instructions and teaching would take place. One expects the persons of high caliber in the relevant field to occupy the post of Professor.

In case the petitioner obtained the Ph.D. Degree from a

recognized University, there should not have been any difficulty in acceding to the request of the petitioner. The record, however, discloses that the Ph.D. Degree obtained by the petitioner is from Vinayaka University, which undertakes the education through distance mode. Whatever may be the relevance or legality of such Degrees for other purposes, they cannot be recognized in the context of promotion of individual to important posts in the University. The petitioner did not challenge the policy decision taken by the University not to recognize the Degrees conferred through distance mode.

The writ petition is accordingly dismissed. There shall be no order as to costs.
