O R D E R:
This Writ Petition has been instituted aggrieved by the inaction on the part of the Tahsildar, Nellore in taking up for consideration the applications submitted by the petitioners for grant of pattadar passbooks and title deeds.
The petitioners assert that they have lodged the applications in Form VI-A under the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 before the 2nd respondent having sent them through registered post which were received in the office of the Tahsildar, Nellore on 26.03.2009. More than two years time has already elapsed. When once an application is lodged with the Tahsildar, he is required to deal with the same in accordance with law and pass orders considered appropriate thereon after hearing the petitioners as well as any known and existing holder of interest/rights in the land.
Since the Tahsildar has not yet passed any orders on the applications said to have been submitted by the petitioners herein on 26.03.2009, it is only appropriate to direct the Tahsildar to deal with the said applications in accordance with law and pass appropriate orders thereon, as stated supra, after hearing the petitioners and also any other person who may have subsisting right/interest in the land in question. Orders considered appropriate be passed within a maximum period of three months from today.
With this, the Writ Petition stands disposed of with the consent of the learned Government Pleader for Revenue. No costs.
