This civil revision petition is filed against the order and decree dated 29-9-2010 in I.A.No.56 of 2010 in O.S.No.348 of 2007 passed by the Junior Civil Judge, Piler, Chittoor district.

2. The petitioner herein is the plaintiff and the respondents are the defendants in the suit before the trial Court.

The present application was filed under Order VI, Rule 17 read with Section 151 of C.P.C., by the plaintiff seeking to permit him to amend the plaint as mentioned in the petition on the ground that after the suit is filed, the 2^nd defendant has highhandedly demolished the constructions made by him on 26-7-2009 and also lodged a complaint with the Police against the defendants and in view of the said fact, he wants to amend the suit for declaration and possession of the property.

4. It is observed by the trial Court in the order under revision that in support of his allegations, the petitioner has not filed any material including the valuation certificate issued by the Sub Registrar, Piler to show the value of the property and to determine the territorial

jurisdiction of the court also. In view of the lacunae the trial Court has passed the order under revision dismissing the application, which need not be interfered with.

Accordingly, the civil revision petition is dismissed confirming the order under revision, granting liberty to the petitioner to file proper application with all the particulars and if any such application is filed, the trial Court is directed to consider and pass appropriate orders on the said application. No costs.
