CRIMINAL PETITION No.12964 of 2011

ORDER:

Petitioners approached this Court with a prayer to quash the proceedings initiated against them in STC.No.74 of 2011 on the file of XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, wherein they are arrayed as the accused for the offence punishable under Section 14 (2) of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 read with Para 76 (b) of Employees’ Provident Fund Scheme, 1952.

After arguing for some time, learned counsel for the petitioners confined his arguments only to the extent of directing the trial Court to take a lenient view, in case the petitioners are found guilty, by imposing some fine, at the time of disposal of the case, and also to dispense with the presence of the petitioners before the trial Court.

Considering the fact that the 1^st petitioner company is not in existence and also considering the nature of the allegations and the submissions of the learned counsel for the petitioners, the XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is directed to take a lenient view, in case the petitioners are found guilty, by imposing some fine, while disposing the case in STC.No.74 of 2011. Further, the presence of the petitioners 2 and 3 before the trial Court is dispensed with except on the dates the learned Judge insists for the same and they shall be properly represented by their counsel.

Accordingly, this criminal petition is disposed of.

The miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
