CRIMINAL PETITION No.12589 of 2011

ORDER:

Petitioner approached this Court invoking the provisions under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.103 of 2011 of Hindupur I Town Police Station, Ananthapur District, whereby he is arrayed as accused for the offence punishable under Sections 447 and 427 of IPC.

Heard.

T he allegation against the petitioner is of encroached the Government land and leveled the same with an intention to sell the same to the villagers.

¶7

Learned counsel for the petitioner submitted that the land in dispute is a water tank bed and as per the directions of this court in the writ petition filed by the petitioner herein, this Court directed the respondents to ensure that no construction is allowed to be made in the water tank bed. The respondents, instead of complying with the directions issued by this Court, filed a false case against the petitioner since the petitioner complained about the encroachments on the water tank bed.

In the facts and circumstances of the case, the first respondentPolice is directed to complete the investigation without making arrest of the petitioner.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions filed along with the Criminal Petition, if any, shall stand closed.
