THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12480 of 2011

ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., to quash the proceedings in Crime No.312 of 2011 of Women P.S., South Zone, Hyderabad, registered for the offence punishable under Section 498-A IPC.

3. Learned counsel for the petitioners submitted that earlier the petitioners approached this Court in Crl.P. No.9418 pf 2011 with a prayer to quash the proceedings against them in the same case, that this Court disposed of the said criminal petition with liberty to the petitioners to approach the concerned District & Sessions Judge and file an application for anticipatory bail, that accordingly, the petitioners filed an application seeking anticipatory bail before the concerned District & Sessions Judge and the same was considered by the District and Sessions Judge and they were released on bail with a condition to execute personable bonds but, the petitioners are not able to execute the bonds as directed by the Sessions Court, and therefore, the present petition is filed with a prayer to quash the proceedings in the same case and also to modify the order passed by this Court in the earlier criminal petition.

4. Considering the facts and circumstances of the case and also for the reason that the petitioners have already granted anticipatory bail, the concerned police are directed to complete the investigation of the case and file final report either way, without arresting the petitioners.

5. With the above observation, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, filed in this Criminal Petition, shall

stand closed.
