CRIMINAL PETITION No.10039 of 2011

ORDER:

Petitioners approach this Court by invoking the provisions under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.691 of 2010 on the file of the V Additional Judicial Magistrate of First Class, Nellore, Nellore District, whereby they are facing charge for the offence punishable under Section 498(A) of IPC.

2. Heard both sides.

3. After arguing for some time, when this Court is not inclined to grant the relief sought by the petitioners, learned counsel for the petitioners-accused by withdrawing the main prayer, prayed the court to dispense with the presence of the petitioners before the court below.

4. Admittedly, in the charge sheet filed by the respondentpolice, there are some prima facie allegations against the petitioners. Hence, this Court is not inclined to quash the proceedings. In any event, considering the nature of offence and the submissions made by the learned counsel for the petitioners, the presence of the petitionersaccused before the trial Court is dispensed with except the dates on which the learned Magistrate insists for their appearance and they shall be properly represented through their counsel before the court below.

5. With the above observation, the Criminal Petition is disposed of. The miscellaneous petitions, if any, filed along with the criminal petition shall stand closed.
