CONTEMPT CASE No.1629 of 2010

ORDER:

This contempt case is filed complaining willful disobedience on the part of the respondents in complying with the order dated 19.11.2009 passed by this Court in W.P. No. 24232 of 2004, whereunder this Court directed the respondents herein to issue pattadar passbook and title deed in respect of the subject land, within a period of two months from the date of receipt of a copy of the order.

Today, when the matter came up for hearing, it is stated by the learned Assistant Government Pleader for Revenue that, as against the aforesaid orders of this Court, non-compliance of which is complained in the present contempt case, the respondents have preferred S.L.P. before the Supreme Court and the same is pending. He further submits that irrespective of pendency of the said S.L.P., the respondents have issued pattadar passbook and title deeds in favour of the petitioners, but however, subject to the outcome of the S.L.P.

Learned counsel for the petitioners submits that in view of the endorsement made on the pattadar passbook and title deeds that the pattadar passbook and title deeds were issued subject to outcome of S.L.P., the petitioners are unable to deal with the subject matter of the property.

In reply, learned Assistant Government Pleader submits that, in case the respondents fail in the S.L.P. before the Supreme Court, they will pass an order, removing the endorsement made on the pattadar passbook and title deeds of the petitioners.

In view of the above submission, no orders need be passed in this contempt case and the same is accordingly closed.
