The petitioner statedly agreed to purchase the house property bearing Door No.17-11-7, Fort Road, Vizianagaram, in an extent of 402 Sq.yards. She entered into agreement of sale with Rudrabatla Venkata Gowriswara Rama Shastry and his sons on 22.10.2002 for a sale consideration of Rs.2,50,000/-. She also paid Rs.2,25,000/- towards part of sale consideration. Rama Shastry died on 17.12.2004. In spite of several demands, his sons did not come forward to execute the sale deed. Petitioner therefore filed O.S.No.4 of 2006 on the file of the Court of the Senior Civil Judge, Vizianagaram, for specific performance of agreement of sale. The Court passed decree in her favour on 06.3.2006. For execution of decree, she filed E.P.No.38 of 2006. Petitioner paid balance sale consideration of Rs.25,000/- by challan dated 14.3.2006, and the Court sent the document to first respondent for registration of sale deed. First respondent issued endorsement dated 12.11.2008 stating that the property belongs to Endowments Department and unless second respondent endorses no objection, sale deed cannot be registered. Aggrieved by the same, present writ petition is filed seeking a writ of Mandamus directing the first respondent to register the document.
