ORDER:
The two petitioners are agriculturists of Katrenipadu Village. They filed the instant Writ Petition alleging that respondent Nos.4 to 6 have converted the agricultural lands in R.S.Nos.272, 273/1, 274 to 276 of the said village without obtaining permission from the Costal Aquaculture Authority (CAA). They therefore seek an order to respondent Nos.1 to 3 to initiate action against the contesting respondents.
The Tahsildar, Razole Mandal, East Godavari District, filed counter affidavit. It is stated in the counter affidavit that respondent Nos.4 and 5 obtained Certificate of Registration vide Reg.No.AP-II2008 (3389) and AP-II-2008 (3390), dated 09.02.2009, under Section 13 of the Costal Aquaculture Authority Act, 2005 (the Act).
The petitioners have not filed any reply affidavit denying the counter averments. Therefore, the Writ Petition is dismissed giving liberty to the petitioners to avail the remedy of appeal provided for under the Act referred to hereinabove. There shall be no order as to costs.
