ORDER:-
This writ petition is filed for the following substantive relief:
“… Hon’ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in issuing the possession notice in FHS A/C.No.13957300001563/316, dated 25.02.2009, in taking over the possession of Flat No.G1 in Ground Floor, constructed in Plot No.99 in Sy.Nos.136, 137, 139 to 142 situated at Block No.1, Commercial Tax Colony, Kothapet Village, Uppal Mandal, Ranga Reddy District, as illegal, arbitrary, unjust, violation of principles of natural justice and consequently direct the 2nd respondent to set aside the same.”
At the hearing, Sri Kishore Babu Yadala, learned counsel for the petitioner, seeks permission of the Court to withdraw the writ petition with liberty to the petitioner to file a civil suit.
The writ petition is accordingly dismissed as withdrawn with
liberty in terms of the prayer made.
As a sequel to dismissal of the writ petition as withdrawn, WPMP.No.7440 of 2010 filed by the petitioner for interim relief is also dismissed.
