“…to issue an appropriate Writ order or direction more particularly one in the nature of Writ of Mandamus declaring action of respondent in issuing the impugned notice dated 29.09.2010 demanding to make application for permission and failure upon threatening to seize the cellular tower situated in R.S.No.175/9B, Jayampu Village, Balayapalli Mandal, SPSR Nellore District, as illegal, arbitrary and without any authority of law and contrary to the provisions of the Panchayat Raj Act.”

At the hearing, it has come out that this Court disposed of W.P.No.27252 of 2010, wherein a demand raised similar to the one impugned in this writ petition has been quashed.

For the same reasons as contained in the said order, the impugned demand is quashed and this writ petition is accordingly allowed with the direction that the reasons contained therein shall form part of this order.

As a sequel to disposal of the writ petition, the interim order, dated 02.11.2010, granted by this Court stands vacated and W.P.M.P.No.34815 of 2010 filed by the petitioner for interim relief is disposed of as infructuous.
