This writ petition is filed seeking a declaration that the inaction on the part of the 4^th respondent-Inspector of Police (Urban), Puttaparthi in providing police protection in terms of the proceedings of the 1^st respondent dated 13.02.2010 for the purpose of measuring the land in survey No.48/2 of Enumulapalli Village, is arbitrary and illegal.

I have heard the learned counsel for both the parties.

The material available on record shows that by proceedings dated 13.02.2010 the 1^st respondent having considered the request of the petitioner dated 28.11.2009 directed the measurements of the land in question should be taken. Having taken a note of the fact that some third parties were obstructing the survey of the land in question, the 1^st respondent requested the 4^th respondent to provide the necessary police protection.

In the counter affidavit filed by the 4^th respondent, it is stated that after the requisition of the 1^st respondent dated 13.02.2010, nobody had approached the police seeking police protection for survey of the land and therefore, the police protection was not provided. It is also stated that the 4^th respondent will provide the required protection for survey of the land as per the letter of the 1^st respondent.

In the circumstances, no further enquiry is necessary and accordingly, recording the statement of the 4^th respondent, the Writ Petition is disposed of with a direction to provide the police protection as and when the 1^st respondent proposes to conduct the survey of the land in question. No costs.
