ORDER: (Per Sri Justice V.Eswaraiah)
Pursuant to the orders of this Court, the Government vide its memo No.11513/F2/2010-2, dated 21.10.2010, requested the Commissioner, Greater Hyderabad Municipal Corporation, Hyderabad, to visit Safilguda Lake along with the revenue officials and identify the encroachments made into the Lake and also the dumping of the building wastage into the said Lake. Accordingly, the Commissioner, G.H.M.C. and Metropolitan Commissioner, HMDA jointly inspected with other senior officials of the Revenue Department and other Departments and submitted a report on 29.10.2010. As per the said report, the Inspection Committee opined that no further action is required in terms of the Safilguda Lake in view of the various measures already taken. But, the Andhra Pradesh Pollution Control Board filed its report stating that the Hyderabad Urban Development Authority (HUDA) provided Sewerage Treatment Plant (STP) for treatment of sewage joining the Lake. The capacity of STP of Safilguda Lake is 0.6 MLD, but the incoming flow (raw sewage effluents) is 4 to 5 MLD. The excess quantity of the sewage effluents is discharging into the lake without treatment. Therefore, as per the analysis report, the water in the
Safilguda Lake is not conforming to ‘CPCB Water Quality Criteria’ indicating that the Lake is polluted with sewage discharge. Therefore, we are of the opinion that the capacity of STP needs to be increased for treating 4 to 5 MLD inflow. As the STP plant is provided by the Hyderabad Metropolitan Development Authority, the HMDA is impleaded as respondent No.4. As the Metropolitan Commissioner, HMDA is a party to the joint inspection report, we direct the 4th respondent to enhance the capacity STP of Safilguda Lake from 0.6 MLD to 5 MLD, so as to enable the treatment of incoming flow (raw sewage effluents) of Safilguda Lake and file appropriate report. We grant four months time from the date of receipt of a copy of this order for filing the said report.
The writ petition is accordingly disposed of.
For compliance, post the writ petition after four months.
