ORDER:
1. This revision petition is filed by the accused questing judgment dated 28.05.2010, passed by the I Additional Sessions Judge, Vizianagaram, in Criminal Appeal No.78 of 2007. The petitioner/accused was convicted by the lower court for the offence under Section 411 IPC and modified sentence of rigorous
imprisonment from one year to six months. This court does not find any reason to interfere with order of conviction made by both the courts below. The petitioner’s counsel contended that the petitioner was sentenced not only in this case but in two other cases and that there is no term in the warrant that of the three sentences shall run concurrently and that this court may modify the warrant to that effect.
2. In the result, the criminal revision petition is dismissed, but ordering running of the sentence passed in C.C.No.859 of 2005 concurrent with the sentences of imprisonment passed in C.C.No.80 of 2005 and C.C.No.81 of 2006 passed by the Additional Judicial Magistrate of the I Class, FAC Judicial Magistrate of the I Class, Special Mobile Court, Vizianagaram.
