The petitioners 1 to 4/A-1 to A-4 are accused of offences punishable under Sections 448, 324, 504, 506/34 I.P.C in C.C. No.737 of 2010 on the file of VII Additional Chief Metropolitan Magistrate, Hyderabad. It is contended by the petitioners’ counsel that false case was foisted by A-1’s husband in collusion with the 1st respondent/defacto-complainant and that the 2nd respondent and A-1’s husband are having illicit intimacy and that with a view to coerce A-1 to agree for divorce with her husband this false case was foisted. Truth or falsity of this case cannot be gone into and decided in this petition under Section 482 Cr.P.C, as it is a question of fact. The offence is said to have taken place on 06.12.2009 at about 8.00 P.M. It is stated that there is medical record for the 1st respondent receiving serious injuries. I do not find any valid reasons to quash proceedings in the pending case before the lower Court. The matter is liable to be decided by the lower Court after full trial.
