JUDGMENT:
The appellants who are defendant Nos.3 and 4 and respondent Nos.2 to 15 are present. The first respondent died and he is being represented by his Legal Representatives who are respondent Nos.10 to 15.
Both the parties have jointly filed this compromise petition along with the terms of compromise under Order 23 Rule 3 read with Section 151 C.P.C. claiming to record compromise between the parties.
In the cause title of the appeal itself, the appellants have stated that respondent Nos.16 and 17 are not necessary parties and they are added as formal parties. In this petition also, it is specifically noted that respondent Nos.16 and 17 are not necessary parties to this petition. Both the learned counsel have also represented that though respondent Nos.16 and 17 have filed separate appeals, they have withdrawn those appeals. Anyhow, since it is mentioned that respondent Nos.16 and 17 are not necessary parties, the appeal stands dismissed against respondent Nos.16 and 17.
The petitioners and respondent Nos.2 to 15 are present before this Court, they are identified by their respective counsel and by the other side. They have also agreed for the terms of compromise as written in the memo of compromise. They have also further stated that on the advise of elders and to avoid prolong legal battle, they have settled their disputes
amicably without any coercion or inducement.
In these circumstances, the appeal is disposed of in terms of the compromise.
