This Court issued rule nisi on 22.10.2009.

This writ petition is filed for a writ of mandamus directing the respondents herein to re-determine the market value of the petitioners in Sy.No.556/1/2 to an extent of Ac. 1-02 guntas and Sy.No.556/1/2 to an extent of Ac. 1-03 guntas respectively totaling in an extent of Ac. 3-07 guntas dry lands in Narsandoddi village H/o Uppair village, Dharoor Mandal, Mahabubnagar District under Section

28-A of the Land Acquisition Act on the application made by the petitioners dated 21.05.2007 basing on the decree and Judgment dated 30.03.2007 in O.P.No.90 of 2003 and batch on the file of Senior Civil Judge Gadwal, Mahabubnagar District and pay the enhanced compensation to the petitioners herein forthwith along with all other statutory benefits.

Several averments in detail had been made in the affidavit filed in support of the writ petition.

The order made in O.P.No.90 of 2003 and batch on the file Senior Civil Judge Gadwal, Mahabubnagar District had also been placed before this Court. The petitions filed under Section 28-A of the Land Acquisition Act, 1894 had also been placed before this Court.

In the light of the facts and circumstances, this Court is of the considered opinion that this writ petition be disposed of as specified hereunder:

In the light of the order made in O.P.No.90 of 2003 on the file of Senior Civil Judge, Gadwal, the applications made by the writ petitioners under Section 28-A of the Land Acquisition Act to be considered in accordance with law. It is needless to say that if the applications had been made as per law the same to be further processed for taking up further steps in this matter.

Accordingly, the Writ Petition is disposed of with the above direction. No costs.
