This Court issued rule nisi on 22.10.2009.

This writ petition is filed for a writ of mandamus directing the respondents herein to re-determine the market value of the petitioners dry lands total an extent of Ac. 14-05 guntas situated within the Limits of Gadwal Municipality, Gadwal Mandal, Mahabubnagar District under Section 28-A of the Land Acquisition Act on the application made by the petitioners dated 18.02.2008 basing on the decree and

Judgment dated 13.12.2007 in O.P.No.37 of 1997 on the file of Senior Civil Judge Gadwal, Mahabubnagar District and pay the enhanced compensation to the petitioners herein forthwith along with all other statutory benefits.

Several facts had been made in the affidavit filed in support of the writ petition and the petitions under Section 28-A of the Land Acquisition Act, 1894 had also been placed before this Court and the order made in O.P.No.37 of 1997 had also been placed before this Court.

In the light of the facts and circumstances and also in the light of the order made in O.P.No.37 of 1997 on the file of Senior Civil Judge, Gadwal, the applications made by the writ petitioners under Section 28-A of the Land Acquisition Act, 1894 to be considered in accordance with law. It is needless to say that if the applications had been made as per law the same to be further processed for taking up further steps in this matter.

Accordingly, the Writ Petition is disposed of with the above direction. No costs.
