Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue an appropriate writ or order more particularly one in the nature of Writ of Mandamus declaring the action of the respondents Nos. 1 to 3 in rejecting the technical bid of the petitioner filed pursuant to the tender notice No. 634/RVN(SSA)/HYD/2008 and further accepting the technical bids of the respondent Nos. 4 to 7 as illegal, arbitrary and consequently direct the respondent Nos. 1 to 3 to accept the technical bid of the petitioner and evaluate the tenders in terms of the tender conditions as prescribed in the tender notice and pass

Since the tenders pursuant to the impugned tender notice were already finalized, nothing survives for adjudication on merits at this point of time. However, the learned counsel for the petitioner states that the petitioner intends to work out the remedies available under law so far as the irregularities committed by the respondents in inviting the tenders. Accordingly, granting leave and liberty to the petitioner to work out the appropriate remedy available under law for redressal of his grievance, this Writ Petition is dismissed as infructuous. No costs.
