This is an appeal filed by the State of Andhra Pradesh, represented by its Secretary, Medical, Health & Family Planning, Director of Medical Education and Superintendent, Government King George Hospital, Visakhapatnam against the
judgment of the learned single Judge in W.P.15553/1999, dated 09.08.1999.
The said writ petition has been filed by the 1st respondent herein seeking to issue a Writ of Mandamus, declaring the action of the appellants 2 and 3 herein in not allowing the II year students of the writ petitioner school in the theory and practical general nursing and mid-wifery examination scheduled to be held from 27.07.1999, as illegal and arbitrary.
As the academic year in question for which the writ petitioner sought for the relief is already over, We are of the opinion that nothing survives for consideration in the present writ appeal and the same has become infructuous.
The Writ Appeal is, accordingly, dismissed as infructuous. No order as to costs.
