On 14-02-2007 the officials of the Civil Supplies Department inspected the premises of the petitioner, who claims to be a licensee under the provisions of the Andhra Pradesh Scheduled Commodities Dealers (Licensing and Distribution) Order, 1982 (for short ‘the Control Order’) and found stocks of pulses --- Bengal Gram, Bengal Gram Dall, Bengal Gram Broken Dall and Gram Husk. They also found that Form-B license was not available and no proper registers are maintained with regard to the stocks stored. The stocks of the scheduled commodities found in the premises were seized, a panchanama was drawn up and a case under Section 6-A of the Essential Commodities Act, 1955 (for short ‘the Act’) is scheduled to

be initiated formally.

According to the petitioner, on 19-02-2007 he submitted a representation for interim release of the seized commodities. The petitioner’s grievance is that his representation has not yet been disposed of by the respondent Nos. 2 and 3.

In the circumstances, after hearing the learned Government Pleader for Civil Supplies, the writ petition is disposed of directing the competent authority to consider and dispose of the petitioner’s application for interim release of the seized commodities. The competent authority shall pass appropriate orders on the petitioner’s application for interim release of the seized stocks without reference to any observation in this judgment and in accordance with law and lawful discretion, within a period of thirty (30) days from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of at the stage of admission. No costs.
