ORDER:
Heard the learned counsel for the petitioner Sri Durga Nageswara Rao, and the learned standing counsel for the respondent Corporation.
This writ petition is filed on an apprehension that the respondent would demolish the huts of the petitioners without notice, opportunity and without following due process of law. Petitioners claimed to be the residents of Govindarajulagutta, Girmajipet, Warangal and to be having huts at the said location, where they are residing for the last 30 years. They claim that the Mandal Revenue Officer, Warangal had issued house site pattas to them in the year 1998-99.
While so, the petitioners vaguely allege that on
03-03-2007, the respondent authorities came on to petitioners’ huts and made markings there on and on enquiries were informed
that steps are being taken to demolish the huts for the purpose of road widening. Apprehending unlawful conduct by the respondent and its officials, the present writ petition is filed.
The learned standing counsel on instructions stated on behalf of the respondent that no steps are being taken by the respondent authorities and no steps will be taken by the respondent to dispossess the petitioners, demolish their huts or occupy their properties without following due process of law.
Recording the said submission on behalf of the respondent, the writ petition is disposed of at the stage of admission. There shall however be no order as to costs.
