ORAL ORDER:
Though interlocutory application is listed, at the request of learned counsel for parties, writ petition itself is heard and disposed of.
The petitioner is a student of M.B.B.S. course. When she was detained to appear for the examination of Anatomy on the ground that she did not possess the requisite percentage of attendance, she approached this court by filing this writ petition.
Though, initially 3rd respondent has sent the particulars of attendance of the petitioner, but, however, by letter dated 2.9.2006, the University was addressed by the Principal that there was some mistake on the earlier occasion in computing the attendance of the petitioner and the petitioner is possessing more than the required percentage of attendance i.e. 75.67% of attendance. This court, by order dated 7.9.2006, while admitting the writ petition directed the respondents to allow the petitioner to write examination in the subject of Anatomy of first year MBBS course. It, however, directed not to announce the result of the said examination.
Though counter-affidavit is not filed, learned Standing Counsel appearing for the University stated that on the earlier occasion, the petitioner was not allowed only on the ground of incorrect information sent by the college, but, however, after scrutiny it is found that the petitioner is having the attendance, which is more than the required and as such, she is eligible to write the examination.
As much as it is admitted that the petitioner was having 75.67% of attendance, I dispose of the writ petition directing the respondents to announce the result of the examination of Anatomy, for which, the petitioner has appeared pursuant to the orders of this court dated 7.9.2006.
Subject to above direction, the writ petition disposed of. No order as to costs.
