Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue an order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents herein in not according permission for felling the forest growth in respect of the petitioners patta lands in Survey Nos.98/2, 98/2 , 98/2 situated at Gangalpet (V) of Khanapur (M), Adilabad District as illegal, arbitrary and malafide and consequently direct the respondents herein to accord permission forthwith to fell the forest growth in respect of patta lands of the petitioner in survey Nos.98/2, 98/2 , 98/2 situated at Gangaipet (V) of Khanapur (M), Adilabad District.

This writ petition is filed aggrieved by the alleged inaction on the part of the respondents in granting permission for felling the forest growth in respect of the petitioner’s patta lands in Sy.Nos.98/2, 98/2 , 98/2 , situated at Gangaipet of Khanapur Mandal, Adilabad District.

Heard the learned counsel for the petitioner and the learned Government Pleader for Forest appearing for the respondents.

The material on record shows that the petitioner made an application on 23-01-2004 requesting permission for felling of trees and same was received in the office of the first respondent-Divisional Forest Officer on 24-01-2004.

In the circumstances, without expressing any opinion on merits, the writ petition is disposed of with a direction to the first respondent-Divisional Forest Officer to consider the representation of the petitioner dated 23-01-2004 and to pass appropriate orders, in accordance with law, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. No order as to costs.
