11-3-2005 to 10-5-2005 pertains to Reach No. 10, Upstream of Prakasham Barrage, Krishna River, Vundavalli, Guntur District to the Petitioner society as illegal and arbitrary and consequentially direct the respondents to consider the representation dt.

This writ petition is filed aggrieved by the alleged inaction on the part of the respondents in considering the representation of the petitioner-Society dated 12.03.2005 for extension of leasehold rights for a period of two months in respect of Reach No.10 of Upstream of Prakasham Barrage, Krishna River, Vundavalli, Guntur District.

Learned counsel for the petitioner states that the reach in question has not been leased out to any third party so far and therefore, a direction may be given to the respondents to consider the request of the petitioner for extension of lease.

The learned Government Pleader though states that subsequently the reach in question was notified and public auction was conducted submitted that he has no instructions as to whether any fresh lease has been granted to any third party.

Accordingly, without expressing any opinion on merits, the writ petition is disposed of with a direction to the respondents to consider the representation of the petitioner dated 12.03.2005 and to pass appropriate orders in accordance with law, in case the leasehold rights in respect of the reach in question have not been granted in favour of any third party as on today. No costs.
