Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue a writ , order or Mandamus declaring the impugned action of the 2nd respondent in not making correction of Place of Birth in the passport No.B 1314421 inspite of the petitioner paying required fee as directed by the 2nd respondent vide his letter dt.2-3-2005 as highly illegal, arbitrary and Violative of Article 14 of the Constitution of India.

This writ petition is filed aggrieved by the alleged inaction on the part of the second respondent-the Passport Officer, Regional Passport Office, Kummarguda, Secunderabad in making the correction of place of birth in the petitioner’s passport bearing No B 1314421.

The petitioner states that in pursuance of the application made by him on 19.01.2005 the second respondent by letter dated 02.03.2005 called upon the petitioner to furnish the desired information/documents within 15 days. The petitioner states that though he has submitted the necessary documents to substantiate his claim, the second respondent failed to pass any orders. Hence this writ petition.

Having heard learned counsel for the petitioner and Sri.B.Kamalakar Rao, learned Standing Counsel appearing for the second respondent, without expressing any opinion on merits, the writ petition is disposed of with a direction to the second respondent to consider the application of the petitioner dated 19.01.2005 on the basis of the information furnished by him on 16.03.2005 and to pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of this order. No costs.
