Acha Chandraiah Vs The Mandal Revenue Officer

Seeking a Mandamus, declaring the action of the respondents in covertly and secretly taking steps to bifurcate the Fair Price Shop No.104, Fort Warangal, Hanamkonda Manda, Warangal District into two Fair Price Shops, without following due process of law or without issuing any notice or giving opportunity to the petitioner, as illegal and violative of principles of natural justice, the present writ petition is filed.

On 14.09.2005, as none appears for the petitioner, the matter is directed to be listed under the caption ‘for dismissal’. Even today, there is no representation on behalf of the petitioner. Heard the learned Government Pleader for Civil Supplies.

The learned Government Pleader for Civil Supplies represented that the matter is squarely covered by the judgment of the Supreme Court in District Collector and another v. B.Suresh and others.

In view of the ratio laid down in the aforesaid judgment, the petitioner has no right to question the action of the respondents in respect of bifurcation of fair price shops. Therefore, the writ petition is devoid of merit and liable to be dismissed.

Accordingly, the Writ Petition is dismissed. No order as to costs.
