ORDER:
For a direction to the respondents to give an opportunity to the petitioner to settle the dues by way of one time settlement by declaring the proceedings issued by the fourth respondent dated 29.07.2005 in E.P. No.221 of 1998-99 as arbitrary and illegal, the present Writ Petition is filed.
Learned counsel for the petitioner contended that the respondents are not accepting one time settlement, even though the petitioner is ready to repay entire amount. On the other hand, the learned Government Pleader for Cooperation, on instructions, contended that the petitioner had already availed opportunity of settling dues under one time settlement scheme, but failed to deposit 1/4th amount within time and therefore, he is not entitled for settlement under the scheme again.
In view of the submissions made by the learned Government Pleader for Cooperation, the petitioner does not deserve to show any sympathy in view of the fact that he has already availed the opportunity under the one time settlement scheme.
The Writ Petition is devoid of merits and is, accordingly, dismissed. No costs.
