ORDER:
Declaring the action of the respondents-corporation in not considering the case of the petitioner for promotion to the post of Hammerman and promoting the 5th respondent as illegal and unjust, the present writ petition is filed.
Heard both sides. Innocuous prayer has been asked for in this writ petition for not considering the case of the petitioner for promotion. In this regard, I am of the opinion
that appropriate decision has to be taken by the respondent-Corporation in accordance with the rules. At the stage, it is brought to the notice of this Court by the learned counsel for the petitioner that the representation of the petitioner has been pending consideration, with the respondent-corporation.
In this view of the matter, without expressing any opinion on the merits of the case, I deem it appropriate to direct the respondents to take appropriate decision and consider the case of the petitioner if he is otherwise qualified and eligible as per rules, within a period of three months from the date of receipt of a copy of this order.
Subject to the above observation, the writ petition is disposed of. No order as to costs.
