Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue a writ, or order or direction more particularly one in the nature of writ of mandamus declaring the proceedings issued by the respondent No.V CAT/ESTT/2004-05 dt.02-11-2004 as illegal, arbitrary and violative of Article 14 of the Constitution of India and the Rules is force and to set aside the same and consequently direct the respondent to reinstate the petitioner forthwith all consequential and incendial benefits including continuity of service. ORDER:
This writ petition is filed by the petitioner aggrieved by the order passed by the respondent-bank dated 02-11-2004 under which the petitioner was dismissed from service of the respondent-bank.
2 . The petitioner has got an effective alternative remedy under the provisions of the A.P. Cooperative Societies Act. Therefore, the petitioner is entitled to avail the said remedy.
3. In that view of the matter, without going into the merits of the case, the writ petition is disposed of granting leave and liberty to the petitioner to avail the efficacious alternative remedy available under the Statute. No order as to costs.
