Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue a writ, order, or direction more one in the nature of Writ of Mandamus declaring G.O.Rt.No.640, Higher Education (EC-2) Department, dt.6.9.2001, issued by the 1^st respondent and consequential proceedings of the 3^rd respondent issued in letter No.APSCHE/CETS/ SECY/NRI/2002 dt.29.6.2002 and the proceedings of the 5^th respondent issued in letter dt.22.8.2002 in refusing the admission of the petitioner in B.Pharmacy course under NRI quota on the ground that the petitioner has not secured 60% in the aggregate or 60% in the optional subjects, as illegal, arbitrary, discriminatory violative of Article 14 of the Constitution of India and consequently direct the respondents to admit the petitioner in 1^st year B-Pharmacy course in the 5^th respondent college under NRI quota forthwith. Learned Government Pleader for Higher Education fairly submits that the question that fall for consideration in this writ petition is squarely covered by an unreported judgment of this Court in Writ Petition, being W.P.No.17872 of 2001 & Batch, dated 18.04.2003. Following the same, the present writ petition is disposed of directing the fifth respondent-college to regularize the admission of the petitioner without insisting upon the requirement of 60% in Intermediate.
