Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue an appropriate Writ, order or direction more in the nature of Mandamus, declaring that the petitioners are entitled for up gradation to the post of Grade-I pandit scale in terms of G.O.Ms.No. 330 Education dated 10-8-1983 R/W G.O.Rt.No. 644 Education dt.7-12-2000 by extending the benefit of judgment dt.12-9-2003 in W.P. No. 26260/2000 and batch of the Division Bench of this Hon'ble High Court, by holding the action of the Respondents in not granting Grade-I pandit scale to the petitioners on par with similarly situated Grade II language pandits in terms of the aforesaid G.O.s is as illegal, arbitrary, discriminatory and subsersive of Articles and 14,16 and 39(d) of constitution of India.

The petitioners who are Grade-II Language Pandits, filed this Writ Petition seeking a direction to the respondents to extend Grade-I pandit scale to them by virtue of G.O.Rt.No.644 of 2000 dated 0712-2000 and by virtue of a judgment of this Court in W.P.No.26260 of 2000 and batch dated 12-09-2003.

The petitioners contend that they were appointed as Grade-II language pandits from 1982 to 1997 on various dates and they were not extended the benefits of G.O.Rt.No.644 of 2000 extending the benefits conferred by the Government in G.O.Ms.No.330 Education dated 10-08-1983 without restricting it to those who acquired requisite qualification till the year 1982.

The learned Government Pleader did not deny the representation of the petitioners regarding the issuance of the G.O. and extending the benefit of Grade-I pandits to Grade-II pandits who have acquired requisite qualifications of Grade-I pandits subsequent to 1982 also. In the light of the judgment of a Division Bench of this Court as mentioned above, and in the light of the circumstances, the respondents are directed to implement G.O.Rt.No.644 of 2000, which modified G.O.Ms.No.330 Education, dated 10-08-1983.

In the light of the judgment of this Court in W.P.No.26260 of 2000 and batch dated 12-09-2003, the Writ Petition is disposed of. No order as to costs.
