The learned counsel appearing for the petitioner Institution submits that the petitioner Institution filed an application for grant of a No Objection Certificate (for short ‘NOC’) for running the Course of GNM. In furtherance of the said application, the respondents made inspection of the petitioner Institution, however, no order has been passed on the said application filed by the petitioner Institution for grant of NOC so far.

After arguing at some length, the learned counsel for the petitioner Institution made a limited prayer that the petitioner Institution would be satisfied if the respondents are directed to take final decision on the application submitted by it for grant of NOC.

Heard and considered.

In view of the limited prayer made by the learned counsel for the petitioner Institution, this Court deems just and proper to dispose of this writ petition with the directions to the respondents to pass a conclusive order on the application submitted by the petitioner Institution for grant of NOC for running the Course of GNM.

The respondents shall pass the order after taking into consideration all the aspects of the law. The exercise of passing the order on the application be completed within a period of thirty days’ from the date of submitting the certified copy of this order.

Since the order has been passed ex-parte, it would be opened for the respondents if they feel any difficulty in complying with this order, they can make application for recalling of this order. The respondents shall pass the order on the application after taking into consideration the fact whether the petitioner has fulfilled all requirements or not.

The stay application and pending application/s, if any, also stand/s disposed of.
