Learned counsel for the petitioner submits that the petitioner was working on the post of Senior Teacher at Mahatma Gandhi Government School, Kundanpura, Sanganer, Jaipur. Learned counsel further submits that recently the petitioner has been promoted on the post of Lecturer at Government Senior Secondary School, DAV, Jaisalmer. He further submits that the petitioner submitted an application/representation for forgoing the promotion allowed to her vide order dated 18.04.2026 (Annexure1) issued by the office of Director, Secondary Education, Rajasthan Bikaner.

Learned counsel further submits that in the application/representation submitted by the petitioner, she stated that she wants to forgo the promotion and she may be permitted to continue at her present place of posting.

Considered the submissions made by the learned counsel for the petitioner and also perused the material made available on record.

The request of forgoing the promotion cannot be considered subject to any condition, but if an employee desires to forgo a promotion, then the respondent authorities should consider the request of forgoing the promotion in a positive manner.

Having considered the submissions made by the learned counsel for the petitioner, the Court feels that the ends of justice would meet if directions are issued to the respondentauthorities to consider the request of the petitioner of forgoing the promotion in accordance with law.

Accordingly, this writ petition is disposed of with a direction to the respondent-authorities to consider the request of the petitioner for forgoing her promotion. However, it is made clear that the request of forgoing the promotion cannot be considered subject to any condition.

This order shall not preclude the respondent authorities from posting the petitioner at the place which they feel in the administrative interest.

In view of he order passed in the main petition, stay application as well as pending application, if any, also stands disposed of.
