At the request of counsel the petition was taken up for final disposal at the threshold. Petitioner's counsel, relying on Firoj Arif Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.18268/2016 and connected matter, Co-ordinate Bench, decided 21.03.2017) and on the order dated 12.02.2014 in S.B. At the request of learned counsel for the parties, present writ petition is considered for final disposal at this stage only.

Learned counsel for the petitioner while placing reliance upon the judgment in the case of Firoj Arif Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.18268/2016) and connected matter decided by a Co-ordinate Bench of this Court on 21.03.2017 submits that the controversy raised herein is no more res integra as same is already decided by this Hon'ble Court. He

further referred order dated 12.02.2014 in S.B. Civil Writ Petition Nos. 9583/2008, 9582/2008 and 9584/2008 decided by a Coordinate Bench at Principal Seat, Jodhpur and submits that the order as mentioned hereinabove is also approved by Hon'ble Division Bench of this Court at Principal Seat, Jodhpur in State of Rajasthan Vs. Dr. Paritosh Ujjwal on 09.07.2025.

Learned counsel appearing on behalf of respondents submits that the writ petition may be disposed of in light of ratio laid down by this Hon'ble Court but a liberty is granted to the Department that in case there is any factual difference about applicability of aforesaid ratio then Department will consider the same.

Having considered aforesaid, the writ petition is disposed of in terms of the judgments in case of Firoj Arif (supra) and Dr. Paritosh Ujjwal (supra) but, in case there is any factual difference or exits any reason to deviate from the ratio, the respondents are at liberty to decide the same with a well-reasoned and speaking order under intimation to the petitioner.

With aforesaid, the present writ petition stands disposed of with pending application(s), if any.
