Rajasthan High Court (Jaipur Bench), single judge (Anil Kumar Upman, J.), disposed of S.B. Criminal Miscellaneous (Petition) No. 1200/2026 preferred under Section 528 of BNSS by Monu Tourist Service Pvt. Ltd. through its director/proprietor Kushiram against the State of Rajasthan. Although the petition initially sought quashing of the orders dated 27.01.2026 and 20.12.2025 passed by the trial court and the revisional court in Case No.191/2025 (State Vs. Suresh) before the Additional Chief Judicial Magistrate, Bahrod, District Kotputli-Bahrod, learned counsel confined himself to a limited prayer for reduction of the bank guarantee of Rs.10 lakhs required for releasing the bus in question to Rs.5 lakhs on the ground of the petitioner's poverty. The petitioner has preferred this Criminal Misc. Petition under Section 528 of BNSS seeking the following relief :-

“It is, therefore, most respectfully prayed that the Hon’ble Court may graciously pleased to accept this misc. petition, and quashed and set aside the orders dated 27.01.2026 and 20.12.2025 passed by the learned trial court as well as the revisional court, in Case No.191/2025 titled as State Vs. Suresh pending before learned Nakul Agarwal, R.J.S., Additional Chief Judicial Magistrate, Bahrod, District Kotputli-Bahrod.”

At the outset, learned counsel for the petitioner makes a limited prayer that furnishing of the bank guarantee of Rs.10 lakhs for releasing the Bus in question may kindly be reduced to Rs.5 lakhs as the petitioner is a very poor person and thus, he is not in a position to furnish such huge bank guarantee.
