The instant bail application has been filed on behalf of the accused-petitioner under Section 483 of B.N.S.S. in connection with FIR No. 130/2025 registered at Police Station Narena, Jaipur Rural, for the offence(s) under Sections 331(4), 305(a), 317(2) and 112(2) of B.N.S., 2023.

Learned counsel for the accused-petitioner submits that accused-petitioner has been falsely implicated in this case. He also submits that the accused-petitioner is in custody since 11.12.2025 and charge-sheet has already been filed. Present offences are triable by Magistrate. He further submits that co-accused persons namely Sunil, Sitaram @ Ladora and Kelash @ Madhu have already been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 25.08.2025 in S.B. Criminal Miscellaneous Bail Application No. 9648/2025, so no fruitful purpose would be served

by keeping the accused-petitioner in custody and therefore, prays that the accused-petitioner may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor vehemently opposed the submissions made by learned counsel for the petitioner and submits that there are criminal antecedents against accusedpetitioner, Ramkishan @ Prakash S/o Baluram @ Bodu. 4. On a conspectus of facts, circumstances and considering the arguments advanced by learned counsel for the petitioner that the accused-petitioner is in custody since 11.12.2025. Considering the fact, that co-accused persons namely Sunil, Sitaram @ Ladora and Kelash @ Madhu have already been enlarged on bail by a Coordinate Bench of this Court vide order dated 25.08.2025 in S.B. Criminal Miscellaneous Bail Application No. 9648/2025 and trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case deems it just and proper to enlarge the accused-petitioner on bail.

Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Ramkishan @ Prakash S/o Baluram @ Bodu is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the Trial Court, by the accused-petitioner with the following conditions:-

(i) It is made clear that the accused-petitioner shall not be involved in any other offence(s) during the currency of the bail and he shall mark his presence on 1^st and 15^th day of every month in the concerned police station.

(ii) The accused-petitioner shall not tamper with evidence or influence the witness in any manner.

(iii) The accused-petitioner shall attend the hearing of the Trial Court on the date fixed by the Trial Court or as and when asked to appear before the Trial Court.

(iv) In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court.
