These bail applications have been filed on behalf of the accused-petitioners under Section 483 of B.N.S.S. in connection with FIR No.447/2025 registered at Police Station Bari, District Dholpur, for the offence(s) under Sections 115(2), 126(2), 351(2), 351(3), 333, 109(1), 189(2) and 324(5) of BNS.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and the injuries sustained by the injured person are not dangerous to life. Learned counsel also contends that the petitioners have no criminal antecedents; accused-Shailendra is in custody since December, 2025 and accused-Abhishek Parmar & Suresh Singh are in custody since January, 2026. Recovery has already been effected. He further submits that charge-sheet has already been filed and conclusion of trial may take long time, so no fruitful purpose would be served by keeping the petitioners in custody and therefore, prays that the petitioners may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor and counsel for the complainant have vehemently opposes the submissions made by learned counsel for the petitioners hereinabove. 4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioners that charge-sheet has already been filed; there are no criminal antecedents registered against the petitioners and accused-Shailendra is in custody since December,

2025 and accused-Abhishek Parmar & Suresh Singh are in custody since January, 2026 and trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case deems it just and proper to enlarge the petitioners on bail.

Therefore, these bail applications under Section 483 BNSS are accordingly, allowed and the accused-petitioners Shailendra Singh @ Shailu S/o Suresh Singh, Abhishek Parmar S/o Shri Netrapal @ Lahaura & Suresh Singh S/o Shri Master

Singh are ordered to be released on bail, provided each of them furnish a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that they shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so.
