The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.57/2026 registered at Police Station, Rupangarh District Ajmer for offences under Sections 318(4), 316(2) and 61(2) of B.N.S.,2023.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. The petitioners are facing allegation of cheating by taking rupees twelve lakhs from the complainant with promise to sell the magical turtle in conspiracy with other accused. He again submits that petitioners have not been named in the F.I.R. No specific role

has been assigned to the present petitioners co-accused Rahul was granted bail by this Court on 07.05.2026. The petitioners are behind the bars since 10.04.2026. Though four cases have been registered against petitioenrs Tarachand and three cases against petitioner Rohitash, however, in all those cases the petitioners have been granted bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently the bail application deserves to be allowed.

Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Tarachand Bawriya S/o Sh. Shankarlal Bawriya and Rohitash Bawriya S/o Sh. Ramnath Bawriya be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
