The instant bail application has been filed by the petitioner -Netrapal Singh S/o Lakhan Singh, arrested in connection with FIR No.4/2024 dated 02.01.2024, Police Station Sikri, District Deeg lodged by the complainant-Bank, for the offences under Sections 420 & 409 B.N.S., 2023.

Learned counsel submits that the petitioner is behind the bars since 04.12.2025. It is further submitted that the allegation against the petitioner pertains to an alleged financial fraud involving the accounts of deceased persons. She further submits that the Police after conducting the investigation, have filed the charge-sheet and no recovery is required to be made from the petitioner. She also submits that, without admitting the allegations, the petitioner is willing to deposit the entire alleged amount of ₹2,25,000/- by way of Demand Draft in the name of complainant-Bank. Therefore, he prayed that the accused petitioner may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application.

Considering the overall facts and circumstances of the present case, the fact that the petitioner intends to deposit the entire alleged fraud amount as mentioned in the impugned FIR, that the charge-sheet has been filed and no recovery is required to be made from the petitioner and without commenting upon the merits or demerits of the case, this Court deems it just and proper to grant bail to the accused-petitioner.

Accordingly, the bail application filed under Section 483 BNSS is allowed and it is directed that accused-petitioner Netrapal Singh S/o Lakhan Singh shall be released on bail in connection with FIR No.4/2024 dated 02.01.2024, Police Station Sikri, District Deeg, provided he executes a personal bond in a sum of Rs.1,00,000/- along with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner shall deposit the said amount, under protest, by way of Demand Draft in the favour/name of complainant-Bank within a period of five days from the date of passing of this order. The petitioner is further directed not to take undue advantage of liberty or misuse the liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
