The present bail application has been filed under Section 483 of BNSS, 2023 against the order dated 13.02.2026 passed by the learned Additional Sessions Judge Kaman, District-Deeg in Criminal Misc. Case (CIS) No.247/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No.18/2026, Police Station Kaithwara, District Deeg for the offences under Sections 111(2)(b), 303(2), 317(2), 318(4), 319(2), 338, 336(3), 340(2) & 61(2)(a) of the BNS, 2023 and Section 66D of Information Technology (Amendment) Act, 2008.

Learned counsel for the petitioner submits that the petitioners are in custody since 29.01.2026. He further submits

that there are no criminal antecedents against petitioner No.1Aasif. However, there are two cases against petitioner No.2-Sahil. 3. Learned counsel further submits that the charge-sheet has already been filed in the present case in the offences triable by Magistrate. He contends that the conclusion of the trial is likely to take considerable time. He further submitted that the petitioners are ready and willing to abide by any stringent conditions that may be imposed by this Court, and accordingly prays that they be enlarged on bail.

Learned Public Prosecutor vehemently opposes the present bail application.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 6. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, and particularly the fact that challan has been filed for the offences triable by Magistrate; the conclusion of trial is likely to take a considerable time; petitioners are in custody since 29.01.2026 which is almost more than 5 months, this Court is of the opinion that the bail application filed by the petitioners deserves to be accepted subject to imposition of stringent conditions.

Consequently, the bail application is allowed . It is ordered that the accused-petitioners namely Aasif S/o Sarfu and Sahil S/o Issar arrested in connection with F.I.R. No.18/2026, Police Station Kaithwara, District Deeg, shall be released on bail; provided each of them furnish a personal bond of Rs.1,00,000/ (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court,

with the stipulation that they shall appear before the said Court on all dates of hearing and as and when called upon to do so until completion of the trial, subject to the following conditions:

(i) The petitioners shall not leave country without the permission of the Court;

¶28

(ii) The petitioners shall not commit any offence similar to the offence of which they are accused, or suspected, of the commission of which they are suspected;

¶29

(iii) The petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence; and

¶30

(iv) In the event the petitioners are found involved in any other case of similar nature in the future, the prosecution shall be at liberty to move an appropriate application before the learned trial Court for cancellation of the bail granted herein.

(v) The accused-petitioners shall mark their presence before the concerned police station once in a month as fixed by the Investigating Officer and a register shall be maintained for the same by Investigating Officer.

(vi) In case of any change of residential address, the accused-petitioners shall immediately inform the Investigating Officer as well as the trial Court.
