The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.426/2025 registered at Police

Station Ramganjmandi, District Kota Rural for offences under Sections 103(1) and 3(5) of BNS, 2023.

Since both these bail applications arise out of common FIR, hence, they are being decided by this common order. 3. Heard learned counsels for the petitioners as well as learned Public Prosecutor and perused the material available on record. 4. Learned counsels for the petitioners contend that the petitioners have falsely been implicated in these cases. It is submitted that in the present matter, the FIR was lodged by the complainant Yashvant Soni, who admittedly was not present at the place of occurrence. Despite this, he alleged in the FIR that Ashok and Gaurav had assaulted his brother Navneet. However, upon completion of the investigation, the police concluded that the present petitioners along with co-accused Gaurav, had attacked the deceased-Navneet resulting in his death. It is further submitted that Ashok also sustained injuries in the same incident. It is further submitted that the statement of the sole eye-witness Ashok has been recorded before the Trial Court and during the course of the trial, he did not support the prosecution case and turned hostile qua the present petitioners. There is no incriminating material available to connect or implicate the present petitioners with the alleged offence.. The petitioners are in custody since 08.12.2025 without any criminal past. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail applications deserves to be allowed.

Learned Public Prosecutor has vehemently opposed the bail applications of the petitioners.

On consideration of the rival submissions and material available on record and in the light of submissions made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Pradeepsingh S/o Tejsingh and Rakshit Alias Gotiya S/o Padam Kumar, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
