The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.249/2025 registered at Police Station Dhod, District Sikar for offences under Sections 103(1) and 3(5) of BNS, 2023.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that it clearly emerges that, on the date of the alleged incident, the petitioner, Arjun Singh, and the deceased were travelling in a pickup vehicle driven by the petitioner. The deceased voluntarily got down from the vehicle and directed the petitioner to proceed ahead. Thereafter, he attempted to board the vehicle from the

conductor's side while it was in motion, accidentally lost his balance, fell on the road, sustained injuries, and succumbed to the same. He further submits that the prosecution case rests solely on the testimony of the eye-witnesses, Manohar Singh and Mukesh Singh, who have been examined before the learned Trial Court as PW1 and PW2 and have not supported the prosecution story and turned hostile. Even the Medical Officer, PW3 Dr. Ranjeet Singh, has stated in his cross-examination that the injuries sustained by the deceased are possible due to motor accident. It is further submitted that the material witnesses, PW1 to PW5, have already been examined and there is no incriminating evidence against the petitioner. Petitioner is behind the bars since 15.10.2025 without any criminal past. Charge-sheet has been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application of the petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and in light of submissions made on behalf of petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Arjun Singh S/o Shri Mohan Singh @ Munshi Singh , be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to

the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
