The present bail application has been filed under Section 482 BNSS in connection with FIR No. 231/2024 registered at Police Station Khairthal District Khairthal Tijara for the offence(s) under Sections 420 and 406 IPC.

Learned counsel for the accused-applicant submits that applicant has falsely been implicated in the matter as the amount of money involved in the alleged offence has already been recovered. It is submitted that the said fact has also been reflected in the bail order of the co-accused-Aabid, who was granted the regular bail vide order dated 06.09.2024, passed by the Coordinate Bench of this Court. Lastly, it is submitted that the matter is triable by the Magistrate.

Per contra , learned Public Prosecutor has vehemently opposed the instant bail application and has submitted that there are as many as three criminal antecedents registered against the accused-applicant.

Having heard the arguments advanced by the learned counsel for the parties and considering the fact that the amount of money involved in the alleged offence has already been recovered; that the co-accused has already been enlarged on bail vide the order dated 06.09.2024, passed by the Coordinate Bench of this Court; that the matter is triable by the Magistrate, and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accusedapplicant subject to the condition that the accused-applicant joins investigation as and when called for.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Khairthal District Khairthal Tijara in F.I.R. No. 231/2024 is directed that in the event of arrest of the accused-applicant Vishnu S/o Harveer Singh , he shall be released on bail, provided he/she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the applicant shall make himself available for interrogation by a police officer as and when required;

(ii) that the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the applicant shall not leave India without previous permission of the court.
