The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 35/2026 registered at Police Station Sadar, Alwar, District Alwar for the offences under Sections 238(b), 316(2), 318(4), 319(2), 336(3), 340(2) of BNS and Sections 66C and 66D of IT Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. The offences alleged to have been committed by the petitioner are triable by Magistrate. There is only one transaction shown by the petitioner which is of Rs. 10,955/- (ten thousand nine hundred fifty five rupees). It is further argued that the age of the petitioner is 19 years. The accused-petitioner is in custody since long and the trial of the case may take considerable time. The charge-sheet

has already been submitted before the concerned trial court, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

Heard and perused the material available on record.

It is alleged against the petitioner that by using fake sim cards, he deceived public at large through social media applications by circulating text messages and petitioner received Rs. 10,955/- from the victim by clicking on the text message link. The investigating officer after thorough investigation has concluded that petitioner was using sim card which was found to be issued in the name of another person and thereafter committed cyber fraud, therefore considering the aforesaid facts, this court is not inclined to enlarge the petitioner on bail.

Accordingly, the present criminal misc. bail application is hereby dismissed.
