The petitioner has filed this second bail application under Section 483 of BNSS in FIR No.469/2024 registered at Police Station Anta, District Baran for offence under Sections 109(1), 115(2), 126(2), 352 and 3(5) of BNS-2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. This is second bail application filed by the petitioner. The earlier bail application of the petitioner was dismissed with liberty to file after recording statements of the injured. Now, it is contended by learned counsel for the petitioner that the statement of injured Ramkalyan has been recorded. He argued that as per the medical opinion, the injury was termed as dangerous to life in absence of treatment, while there is ample material on record which shows that proper treatment was given to injured. again submits that the petitioner is behind the bars since 28.01.2025, the trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Rampratap Bairwa S/o Kishan Lal Alias Kashan Lal, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
