This bail application has been filed on behalf of the accusedpetitioner under Section 483 of B.N.S.S. in connection with FIR No. 342/2023 registered at Police Station Ramnagariya, Jaipur City(East) for the offence(s) under Section(s) 323 , 341, 420, 406, 467, 468, 471, 504 and 120-B of IPC.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and dispute appears to be of a civil nature. Learned counsel also submits that seven other criminal cases have been registered against the petitioner and in most of the cases he has been bailed out. He further submits that the alleged offences are triable by Magistrate. He submits that petitioner is in custody since 06.12.2025 and conclusion of trial

may take long time, so no fruitful purpose would be served by keeping the petitioner in custody and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS.

Per contra , learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove.

Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner that the alleged offences are triable by Magistrate and petitioner is in custody since 06.12.2025; trial will take considerably long time in its conclusion. Without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Chhotilal S/o Late Sh. Bhagwan Sahai is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
