Instant Civil Contempt Petition has been filed alleging disobedience of the final order dated 09.10.2024 passed in D. B. Civil Writ Petition (PIL) No.15770/2024. For ready reference, the order dated 09.10.2024 reads as under :-

"1. This PIL petition has been preferred by the petitioners ventilating grievance with regard to inaction on the part of the respondents-authorities in not taking any action towards removal of encroachment on pasture land.

We are of the view that the petitioners should submit an application under Section 91 of the Rajasthan Land Revenue Act,1956 within a period of one month before Tehsildar, Tehsil Sikrai, District Dausa. On such application being submitted, Tehsildar shall draw appropriate proceedings, issue notice to those who are alleged to be encroachers and after affording opportunity of hearing to them, proceed to pass appropriate order one way or the other.

Writ petition is, accordingly, disposed off.

It is made clear that we have not commented anything on merits of the case.”

Indisputably, in furtherance thereto, petitioners moved an

application under Section 91 of the Rajasthan Land Revenue Act, 1956, whereupon the order dated 27.11.2024 was passed by the Nayab Tehsildar, Sikrai (Dausa), directing to remove the encroachment from Khasra Number 438. Petitioners have raised a grievance that encroachment from few other Khasra numbers have not been removed.

It is noteworthy that the order dated 27.11.2024 was never challenged by the petitioners and same has attained finality.

In the instant contempt petition, it is not the case of petitioners that the order dated 27.11.2024 has not been complied with. The scope of contempt petition may not be allowed to be enlarged than the main order dated 09.10.2024 and indisputably, in furtherance to said order, Teshildar has passed final order dated 27.11.2024, which too has been complied with.
