Learned for the petitioners have unanimously submitted that the candidature of the petitioners is ought to be considered on merits as they are eligible for merit yet their final result/appointment are withheld for no justified reasons. Further, learned counsel have relied upon the order dated 07.10.2024 passed in Dimpal Kumari VS. State of Raj. & Ors. registered as SBCWP No. 14929/2024 and have submitted that present lis is no more res integra and present matters can be disposed of in terms of Dimpal Kumari (supra) .

Learned counsel for the respondents has submitted that present petitions can be disposed of with the directions to carry out re-verification of the documents and has assured that the said process will be carried out within a period of three weeks.

Considering the abovesaid submissions and the consensus drawn inter-se the parties, the present petitions are disposed of in terms of the ratio made applicable in the afore-relied judgment.

Kumari (Supra) is reproduced herein below:

“These writ petitions are disposed of in following terms as agreed and requested by learned counsels for the respective parties:

(1) One post of Female Health Worker pursuant to advertisement dated 19.05.2023 shall be kept vacant for each of the petitioners in the district(s) of their preference vis-a-vis their merit position till final verification of their experience certificate.

¶66

(2) The petitioners shall be posted as per their preference vis-a-vis their merit position if found eligible ultimately qua their experience certificate. Pending application(s), if any, also stands disposed of accordingly.”

It is directed the re-verification process be carried out within a period of three weeks, from the receipt of the certified copy of this order.

In terms of the above, the present petitions are disposed of. Pending applications, if any, shall stand disposed.
